How to Document Property Condition for Legal Protection

Three years ago I lost a security deposit dispute I should have won, and it cost me about 85,000 yen out of my own pocket. The tenant claimed a kitchen scratch was pre-existing; I had no proof either way, so the arbitration split the difference against me. Since then I’ve photographed every single unit, every single turnover, across all 9 of my properties, and I haven’t lost a documentation argument since.

Good condition records aren’t paperwork for its own sake. They’re the difference between a five-minute conversation and a drawn-out dispute that eats your weekend and your money.

Why move-in documentation matters more than move-out

Most landlords photograph a unit when a tenant leaves, thinking that’s when it counts. I used to do the same thing until I realized the move-out photos only tell you what changed if you have something to compare them against. Without a move-in baseline, every scuff mark becomes an argument about who caused it.

Now I photograph every unit within 24 hours of a tenant taking possession, before they’ve moved in a single box. That timing matters u2014 once furniture is in the room, you can’t see the corners, the baseboards, or the floor underneath. I learned this the hard way after missing a pre-existing water stain in a closet that later got blamed on my outgoing tenant.

The 40-photo minimum I use for every turnover

I settled on a minimum of 40 photos per unit after a 2LDK dispute where 15 photos weren’t enough to prove the condition of every wall. My checklist now looks like this:

  • Every wall in every room, shot straight-on under normal lighting (roughly 4-6 photos per room)
  • All flooring, including under any furniture that’s already in place
  • Every window, including the tracks and screens, where mold and grime hide
  • Bathroom fixtures, grout lines, and the underside of the sink cabinet
  • Kitchen appliances, both inside and outside, plus the range hood filter
  • Entry door, both sides, and any keys or fobs being handed over
  • A wide shot and a close-up of any existing damage, no matter how minor

This takes me about 35 minutes per unit. Compare that to the 6 hours I spent on that deposit arbitration, and it’s obviously the better use of my time.

Timestamps and metadata beat memory every time

Photos alone aren’t bulletproof if a tenant can argue you took them at a different time. I use my phone’s default camera app because it embeds timestamp and GPS metadata automatically, and I never edit the originals u2014 I duplicate them first if I need to crop or annotate. For each turnover, I also keep a simple folder named with the date and unit number, so there’s never a question about when the images were captured.

For roughly 60,000 yen a year, I also pay for basic cloud backup across two services. It sounds like overkill until you consider that a single lost phone with three years of turnover photos on it would leave me defenseless in any dispute filed within that window.

Written condition reports fill the gaps photos miss

Property Inspection Forms & Checklists

Document everything. A signed checklist at move-in prevents every deposit dispute.

Photos show what a room looks like, but they don’t capture things like a wobbly doorknob or a faint smell of mildew. I pair every photo set with a one-page written report that rates each room on a simple 1-5 scale (5 being like-new) and lists any functional issues separately from cosmetic ones. This report takes maybe 10 minutes to fill out, and both the tenant and I sign it at move-in.

I’ve found that having the tenant walk the unit with me and sign off on the condition report cuts move-out disputes by more than half. When people participate in documenting the baseline, they’re far less likely to argue about it later u2014 they were there, and their signature is on the page.

Building a dispute-proof paper trail over time

Documentation isn’t a one-time event; it’s an ongoing habit. Every time I do a repair visit, even a small one like fixing a running toilet, I snap two or three photos of the surrounding area. Over a typical 2-3 year tenancy, this builds a timeline that shows normal wear happening gradually rather than all at once, which matters if a dispute ever goes to arbitration.

What to do when a dispute actually happens

Even with good records, disputes still come up u2014 I’d guess I handle 2 or 3 a year across my portfolio. When one lands, I pull the move-in photo set, the signed condition report, and any mid-tenancy repair photos into a single folder and lay them out side by side with the move-out photos. In every case where I had full documentation, the conversation ended within a single email exchange. The cases that dragged on were always the ones from before I tightened up this system.

That’s the approach I use across all 9 of my properties now, and it’s turned what used to be my most stressful part of being a landlord into one of the most routine.
