About twice a year, one of my tenants calls or messages me to say they need to move out early u2014 a job transfer, a marriage, a family emergency. Over 15 years of self-managing 9 rental units, I’ve handled 27 early termination requests, and only 3 of them turned into anything close to a real dispute.

Most landlords panic the moment they hear breaking the lease and either roll over completely or dig in and refuse everything. Neither approach protects your cash flow. Here’s the process I actually use every time it happens.

Job transfers make up about 40% of my early termination cases u2014 Japanese companies still move employees on short notice, sometimes with as little as 3 weeks’ warning. The rest split fairly evenly between marriage or moving in with a partner, health issues in the family, and occasionally friction with a neighbor that the tenant doesn’t want to deal with anymore. Financial hardship is rarer than people expect u2014 maybe 2 or 3 cases out of my 27.

Knowing the real reason matters, because it tells you how much flexibility to offer. A tenant relocating for work with proper notice is a very different negotiation than someone trying to walk away from a rent increase.

What My Lease Contracts Actually Say About It

Landlord-Tenant Law Guides

Know exactly what you can and cannot do u2014 essential reading before any dispute.

Every one of my leases requires 30 days’ written notice before move-out, and most include a penalty clause: one month’s rent if the tenant leaves within the first 12 months of a new 2-year term. After that first year, the penalty usually drops to zero as long as proper notice is given. If your contract doesn’t spell this out clearly, fix it at the next renewal u2014 vague termination clauses are what cause the ugly disputes.

I also keep a hoshounin (guarantor) or a hoshou gaisha (rent guarantee company) on every lease. That single habit has saved me from chasing unpaid rent more than once when a tenant left in a hurry.

My Step-by-Step Process When a Request Comes In

I follow the same checklist every single time, no exceptions, even for tenants I like:

  • Get the request in writing u2014 an email or a LINE message with a clear proposed move-out date
  • Pull the contract and check the exact notice period and any penalty clause
  • Confirm the move-out date, key return method, and schedule the exit inspection within 3 days of that date
  • Calculate the penalty fee and present it as a specific yen amount, not a vague reference to the contract
  • List the unit for the next tenant as early as legally and practically possible, ideally 30 to 45 days before the current tenant leaves

Skipping any of these steps is where landlords get burned u2014 usually the written confirmation step, which matters most if a dispute ever escalates.

Negotiating the Penalty Fee Like a Human Being

Property Inspection Forms & Checklists

Document everything. A signed checklist at move-in prevents every deposit dispute.

Here’s a real example from last year. A tenant on a 2-year lease left after 8 months for a job relocation to Osaka. The contract called for a full month’s penalty, which came to 85,000 yen for that unit. He gave me 45 days’ notice instead of the required 30, so I cut the penalty to 42,500 yen. He was relieved, I still covered part of my vacancy risk, and he left the unit spotless on his way out.

My rule of thumb: full notice plus a clean handoff earns a reduced fee, sometimes waived entirely if the tenant helps show the unit to prospective renters. Short notice or a messy move-out gets the full penalty, no exceptions. Tenants respect a system that’s consistent even when it’s firm.

Turning the Vacancy Around Fast

An empty unit costs me roughly 95,000 yen a month in lost rent on average across my portfolio, so speed matters more than squeezing every last yen out of a penalty fee. When I get 30 days’ notice or more, I list the unit immediately using photos I already have on file, and I budget 30,000 to 50,000 yen for a quick repaint and cleaning before the next move-in.

With that head start, I’ve kept vacancy under 2 weeks in about 80% of my early termination cases. Without it, vacancies have stretched past 6 weeks. The lesson took me a few painful units to learn: don’t wait for the tenant to actually leave before you start marketing.

When I Say No

I don’t negotiate on zero-notice departures, and I don’t waive penalties for a tenant who’s already 2 months behind on rent and using relocation as an excuse to disappear. In those cases, the guarantor or guarantee company becomes the point of contact, and I document everything in case it heads toward small claims. Out of 27 requests, that’s only happened 3 times, but having a firm line matters u2014 the moment tenants sense the rules bend for anyone who pushes hard enough, you lose control of every lease you manage.

That’s the approach I use across all 9 of my properties u2014 get it in writing, check the contract, negotiate the fee like a human being, and get the unit back on the market before the last box is out the door.
